I did check, and yes, ENoM does exist. Not that it really kicks in until you have so many mines you can just bury the aliens under a tidal wave of materiel. I checked my biggest save, and I have an ENoM penalty of -105 (the equivalent of just 3.75 command center rings) from 15 outposts, 48 settlemen...

Another possibility is that both you and the Alien Administration share an ally with an army or nuclear weapons. If you hover over a nation in the manage-relations UI, it'll usually tell you why you can or can't perform a given action.

The real problem isn't the change to require suppression of orbital defenses. The real problem is that the aliens are only really limited by exotics and maybe a fixed amount of mission control, so they don't need farms, they don't need labs, they don't need geriatrics, they need fewer nanofacturing ...

Alien councilors can spawn from alien facilities as well as incoming transport ships. Your save is probably technically salvageable if you don't mind a lot of savescumming after each successful +unrest mission. Otherwise, I don't think it's practical unless you can keep parts of Earth free to build ...
